The contention raised on behalf of the applicants is that recovery is not from the conscious possession of the applicants rather they were passers by and the police implicated them due to some oblique motive.

In view of the above, the applicants are entitled to bail.

Let the petitioners above named be enlarged on bail on his furnishing the bail-bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with P.R.
