====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2019 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners seek bail in a case for the offence registered under Sections 147, 148, 149, 323, 307, 504, 506 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that co-accused Mana Choudhary fired upon one Ajay Choudhary sustaining injury on the back and he fell down. The informant identified Surendra Choudhary, Pintu Choudhary (petitioner no. 2), Ramdhani Choudhary, Vikash Choudhary, Akash Choudhary and Shiv Govind Choudhary and other co-accused persons in the light of electricity,
Patna High Court CR. MISC. No.65978 of 2019(2) dt.17-10-2019 2/2 It has been submitted by learned counsel for the petitioners that the petitioners are languishing in custody since 21.07.2019. Charge sheet has been submitted in the present case. The petitioner no. 1 has got no criminal antecedent. They have falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The allegation of assault is against co-accused Mana Chaudhary. No allegation of assault is against petitioners. On behalf of the learned counsel for the State, it has been submitted that the petitioners are named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bikramganj, Rohtas, in connection with Dinara P.S. Case No. 200/2019.
