====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 13-03-2019 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The report of the learned trial Judge dated 21.02.2019 reveals that four prosecution witnesses have already been examined and bailable warrant has been issued against the official witnesses.
Let the Superintendent of Police, East Patna ensure production of the remaining prosecution witnesses in connection with Khajekala P.S. Case No. 144 of 2017 corresponding to Sessions Trial No. 712 of 2012 pending in the Court of learned 5th Additional Sessions Judge, Patna City.
Patna High Court CR. MISC. No.80441 of 2018(3) dt.13-03-2019 2/2 The learned District Judge, Patna shall ensure that the case is running in a working Court and not a vacant Court. The petitioner is main assailant, hence, I am not inclined to enlarge the petitioner on bail for the present in connection with the aforesaid case.
Let the trial be concluded within a period of six months from the date of receipt/production of a copy of this order.
