Petitioner seeks bail in Darpa P.S. Case No. 69 of 2015 instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324, 307, 379 and 504 Indian Penal Code. It is alleged against petitioner that he assaulted younger son of the informant, namely, Suresh Prasad, with spade on his head.

Injury report of Suresh Prasad is enclosed as Annexure-5. The doctor has found swelling on the chest and one incised wound of size 11⁄2" x 11⁄2" x 1⁄4" over right shoulder. There is case and counter case between the parties. Petitioner's side has also lodged First Information Report against the informant and his son vide Darpa P.S. Case No.70 of

Patna High Court Cr.Misc. No.76974 of 2018(2) dt.20-12-2018 2/2 2015 and 71 of 2015.

Petitioner is said to be in custody since 09.10.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Motihari, in connection with Darpa P.S. Case No. 69 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner.
