JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 290 of the Indian Penal Code and section 30(A) of the Bihar Excise Act 2016. The alleged recovery is said to have been made from banana and bamboo orchard of the petitioner which is an open place and no one has claimed to have seen the petitioner keeping the seized liquor.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand)

Patna High Court Cr.Misc. No.237 of 2019(2) dt.17-01-2019 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge Excise Act, Begusarai in connection with Chariyabariarpur ( Manjhaul O.P) P.S. Case No. 214 of 2018.
