2. Heard learned senior counsel for the petitioner and learned counsel for the respondent no.1.

3. The petitioner is aggrieved by the order dated 19.09.2022 passed by the learned Sub Judge-IX, Patna in Title Suit No. 33 of 2021 whereby and whereunder the learned trial court rejected the petition dated 27.07.2022 filed under Order 7 Rule 11 (d) of the Code of Civil Procedure (hereinafter referred to as 'the Code'.

4. Apparently, against such order, civil revision would lie and the petitioner has wrongly approached this Court by filing civil miscellaneous petition.

5. Faced with situation, learned senior counsel

Patna High Court C.Misc. No.7 of 2023(7) dt.04-03-2025 2/2 appearing on behalf of the petitioner seeks permission to convert the instant civil miscellaneous petition into civil revision petition under Section 115 of the Code.

6. As prayed, the learned counsel for the petitioner is directed to do so within eight weeks.
