1. Heard Mr. Tilak Sao, learned counsel for the petitioner and Mr. Binod Kumar No. 3, learned APP for the State.

2. The petitioner seeks regular bail in connection with Jakkanpur P.S. Case No. 390 of 2024 dated 24.07.2024 registered for the offence(s) punishable under Sections 115(2), 126(2), 85, 3(5) of the B.N.S., 2023 and Sections 3 and 4 of the D.P. Act.

3. The main submissions advanced by petitioner's

Patna High Court CR. MISC. No.79404 of 2024(7) dt.09-04-2025 2/3 counsel are that the petitioner is the husband of the O.P. No.2 and their marriage took place several years ago as there are two daughters from their conjugal relationship and the petitioner was granted provisional bail vide order dated 19.11.2024 on this condition that he would bring his wife to his house and would keep her with full dignity and thereafter, after being released on provisional bail, the petitioner went to the parental house of the O.P. No. 2 on 13.01.2025 and also on 18.01.2025 and requested the parents of the O.P. No.2 to send the O.P. to her sasural with him but his wife (O.P.) flatly denied to return to her sasural and in this regard, a specific statement has been made in the supplementary affidavit. It is further submitted that regarding the alleged physical cruelty, there is no any medical evidence.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner and submits that there is serious allegation against the petitioner.

5. No one appears on behalf of the O.P. No. 2.

Considering the facts and circumstances of the case as well as aforesaid submissions advanced by petitioner's counsel, this court is inclined to confirm the provisional bail granted to the petitioner. Accordingly, the relief of provisional bail granted to the petitioner vide order dated 19.11.2024 in

Patna High Court CR. MISC. No.79404 of 2024(7) dt.09-04-2025 3/3 connection with Jakkanpur P.S. Case No. 390 of 2024, is hereby confirmed on the same bail bond taken under the said order.
