2. The petitioner seeks bail in connection with Yadopur P.S. Case No. 94 of 2024, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per prosecution case, 639 litres country made liquor has been recovered from the a boat near the bank of river Gandak.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated merely on suspicion. No incriminating article has been recovered from the conscious possession of this petitioner. Petitioner has got no criminal antecedents. He is in

Patna High Court CR. MISC. No.76604 of 2024(2) dt.25-10-2024 2/2 custody since 05.09.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the rival submissions, nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIII-cumExclusive Special Excise Court No. I, Gopalganj, in connection with Yadopur P.S. Case No. 94 of 2024.
