2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 (1) , 191 ( 2 ), 191 (3) , 109, 74, 117 ( 2 ) and 352 of the BNS. 3 . As per the prosecution case , informant namely , Babu Lal Sahni alleged that on 21.12.2024 , when informant was on his field, all the F.I.R. named accused persons including these petitioner variously armed came there and assaulted informant, his wife and son due to which they sustained

Learned counsel for the petitioners contended that it is evident from the F.I.R. that as many as 13 persons have been made accused in this case and out of them, specific accusation of assault is against co-accused Santosh Sahni. So far as these petitioners are concerned, there is no specific allegation of any overt act attributed against them. Allegation is general and omnibus against these petitioners. Informant is father of petitioner No. 1 and petitioner No. 2 is wife of petitioner No. 1 who has also lodged a case against informant and others. Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid fact, general and omnibus allegation against these petitioners, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class (East ) Muzafffarpur in connection with Minapur P.S. Case No. 422 of 2024 , subject to the
Patna High Court CR. MISC. No.72140 of 2025(2) dt.14-10-2025 3/3 conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
