====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 31-10-2025 Heard Mr. Siddharth Harsh, learned counsel appearing on behalf of the petitioner and Mrs. Gulnar Begum, learned A.P.P. for the State.

2. The present application has been filed for modification of the order dated 04.07.2025 passed in Criminal Miscellaneous No. 43239 of 2025, by which, learned District Court was directed to obtain a report from the District Transport Officer, Rohtash relating to vehicle bearing Registration No. BR1X 9489 and time was granted to the petitioner to surrender before the learned District Court within a period of six weeks from the date of passing of the said order. However, the District Transport Officer, Rohtash could not furnish report within the stipulated time and time granted to the petitioner to surrender

3. Learned counsel appearing on behalf of the petitioner has given specific information in paragraphs no. 6 and 8 of the present application, which inter alia are reproduced hereinafter:

"6. That the afore mentioned order dt. 04.07.25 was communicated to the learned court below on 26.07.2025 and the report with respect to the status of the alleged vehicle whether the same was stolen one or not, was not received in the court below and as per knowledge of the petitioner the same is still awaited. The court below passed order dt. 26/07/2025.

8. That the petitioner could not surrender in the court below and furnish bail bond within time of six weeks as granted by this Hon'ble court in terms of the order dt.04/07/2025 which has already expired due to inevitable circumstances and the petitioner would suffer irreparable loss if the time for furnishing bail bond is not being extended."

In such circumstances, the District Transport Officer, Patna and the District Transport Officer, Rohtash are directed to furnish report relating to vehicle bearing Registration No. BR1X 9489 forthwith in the Court of learned Exclusive Special Judge, Excise Court No. 2, Rohtas at Sasaram. If the report is not submitted well within a period of one week from the date of communication of this order, the petitioner, in that case, is directed to be released on bail. Further period to surrender before the learned District Court is also extended till 17.11.2025

5. Let a copy of this order be communicated to the Transport Commissioner-cum- State Transport Secretary, Government of Bihar, the District Transport Officer, Patna and the District Transport Officer, Rohtash for taking necessary action and ensure that the order is complied.

6. The order dated 04.07.2025 passed in Criminal Miscellaneous No. 43239 of 2025 is modified to the extent as indicated above. The other parts of the order shall remain intact.

7. Accordingly, the present modification application stands disposed of.
