The petitioner apprehends his arrest in Complaint case No. 54 of 2016 for the offences allegedly committed by the petitioner under Section 406, 420, 120B of the Indian Penal Code.
The complainant alleged that he entered into an agreement to sale the vehicle to Baiju Sahni on condition that he would pay the entire dues of the finance company. Baiju Sahni stopped payment of installments of finance company on such the finance company seized the vehicle and sole the same to Naresh Mahto.
The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.80099 of 2018(2) dt.15-01-2019 2/2 Baiju Sahni has already been granted anticipatory bail vide order passed in Cr. Misc. No. 62021 of 2017. The petitioner is only a witness of the agreement to sale executed between complainant and Baiju Sahni.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub divisional Judicial Magistrate, Benipur, Darbhanga in connection with Complaint Case No. 54 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
