The petitioner seeks bail in Puraini P.S. case no. 220 of 2018 instituted for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

In the written report, it is alleged that one speeding Alto car was seen coming towards Puraini Akhara Chowk which was intercepted by the police party. The driver of the said vehicle overlooked their signal and sped away. Thereafter the informant on chase found that the Alto vehicle fell into a ditch. It is further alleged that four persons started to run away. Out of them two persons were apprehended which include this petitioner.

Learned counsel for petitioner submits that aforesaid

Patna High Court Cr.Misc. No.80058 of 2018(2) dt.24-01-2019 2/2 Alto car does not belong to this petitioner. He has no concern with the country made liquor recovered from Alto Car. Petitioner has been arrested merely on suspicion. Petitioner is in custody since 27.11.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ-II-cum Special Judge, Madhepura in connection with Puraini P.S. case no. 220 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
