JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Dhaka P.S. Case No. 288 of 2018 registered for the offence punishable under Section 498A/34 of the Indian Penal Code.
Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand.
Submission of learned counsel for the petitioner is that he is still ready to keep his wife with him. Heard learned APP and learned counsel for the informant, who has submitted that informant is also ready to live with the petitioner.
In such view of the matter, this application is disposed

No.80094 of 2018(3) dt.21-02-2019 2/2 of with a direction to the petitioner to appear before the court below on 8.3.2019 with an application stating that he is ready to keep his wife with him with all dignities and care and on such application learned court below shall issue notice to opposite party No.2 and on her appearance the petitioner shall be released on provisional bail for a period of six months allowing the petitioner to take opposite party No.2 with him in his house and during that period the court below shall watch their conduct by calling them in the first week of each month and once the court is satisfied with their conduct the bail bond of the petitioner shall be confirmed by the court below itself, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bond of the petitioner.
