The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons, variously armed, came to the house of the informant and assaulted his father due to which he sustained injury and later succumbed to the injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.5.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

Patna High Court CR. MISC. No.66456 of 2019(4) dt.04-03-2020 2/2 submitted in the present case. The petitioner has falsely been implicated in the present case. As per the allegation, two persons are said to have fired upon the deceased including the petitioner. From the post-mortem report, it is evident that deceased has sustained only single fire arm injury. It cannot be ascertained that who had caused fatal injury on the deceased. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 606/2018.
