Petitioner is in custody in connection with Salimpur P.S. Case No. 324 of 2018 for the offence under section 30(a) of Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent.

In the instant case, 30 liters of country wine was recovered from a vehicle which was kept under a sack. Learned counsel for the petitioner submits that the petitioner is in custody since 29.11.2018 and he was driver of the vehicle and he was unaware of the liquor kept in the vehicle in question.

Considering the fact that petitioner has no criminal
