The petitioner seeks anticipatory bail in connection with Makhdumpur P.S.Case No. 148 of 2017, registered for offences punishable under Sections 379 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is of theft the motorcycle of the informant but later on, the same has been recovered from the house of the petitioner. Submission of the learned counsel for the petitioner is that the petitioner has not committed any offence and he has falsely been implicated in this case and one friend of the petitioner parked the motorcycle in his house and he has no knowledge about this and the petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.357 of 2019(3) dt.27-03-2019 2/2 Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances as discussed above, the case of the petitioner is concerned, I am not inclined to grant bail to the petitioner, Accordingly, prayer of anticipatory bail is rejected. This application is accordingly dismissed.
