2. The petitioner apprehends his arrest in connection with Sangrampur P.S. Case No. 229 of 2023, registered for the offences punishable under Sections 341, 342, 323, 307, 308, 379 and 504/34 of the Indian Penal Code.
3. The allegation against the petitioner is of causing assault to the informant by means of iron rod over her head leading to serious injury, besides further allegation against other co-accused persons of assault and snatching of the valuables.
4. Learned Advocate for the petitioner contended that both the parties are next door neighbours and on account of a dispute pertaining to drainage, they entered into a free fight,
Patna High Court CR. MISC. No.73951 of 2025(2) dt.21-11-2025 2/3 resulting into injuries to persons of both the sides. There is a counter version of the present case, being Sangrampur P.S. Case No.230 of 2023 instituted against the informant and his family members. So far the injury sustained to the informant is concerned, it is submitted that the same is simple in nature. To that extent, specific statement has been made in para-7 of the bail application. One of the co-accused persons, namely, Harihar Chaudhary @ Harihar, who is having identical allegation has been allowed the privilege of anticipatory bail by a Bench of this Court in Cr. Misc. No.1096 of 2024 vide order dated 29.01.2024.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application and submitted that the informant has been assaulted by the petitioner by means of iron rod over vital part of her body.

Regard being had to the submissions made on behalf of the parties and taking note of the factum of case and counter case, coupled with the fair antecedent of the petitioner as also his statement that the injuries which are sustained to the informant have been found to be simple in nature, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four

No.73951 of 2025(2) dt.21-11-2025 3/3 weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, East Champaran, Motihari in connection with Sangrampur P.S. Case No. 229 of 2023, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioner.
