This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Bhagwan Bazar PS Case No. 462 of 2018 for the alleged offence under Section 8/20 (b)(ii)(B) of the NDPS Act. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent and he is in custody since 25.10.2018 in a case involving seizure of 14 kgs. of ganja. Learned counsel further submits that the quantity of ganja is not commercial one. Learned counsel also submits that petitioner is the driver of the tempo and he has no knowledge or concern with the ganja kept inside the tempo.

Considering the totality of fact situation, this

Patna High Court Cr.Misc. No.80621 of 2018(2) dt.16-01-2019 2/2 application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Saran at Chapra in connection with Bhagwan Bazar PS Case No. 462 of 2018 subject to the condition that bailors should be the local persons having sufficient landed property.
