The petitioner seeks bail in Tatarpur (University) P.S. case no. 159 of 2018 instituted for the offence under Sections 456, 379, 412 of the Indian Penal Code. It is alleged in the written report that on the date of occurrence, two persons came on motorcycle in front of gate of Marwari college and the pillion rider of the motorcycle snatched the golden chain of the informant. The informant caught hold the driver of the motorcycle and pillion rider managed to run away.

Learned counsel for petitioner submits that there is specific allegation levelled against pillion rider in the written report. This petitioner has no knowledge about said pillion

Patna High Court Cr.Misc. No.80086 of 2018(2) dt.24-01-2019 2/2 rider. There is no recovery from possession of this petitioner. Petitioner is in custody since 1.08.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM VII, Bhagalpur, in connection with Tatarpur (University) P.S. case no. 159 of 2018, subject to the condition that both the bailors shall be the close relative of the petitioner.
