The petitioner seeks bail in Simri P. S. Case No. 130 of 2018 instituted for the offence under Section(s) 363 of the Indian Penal Code .Later on Sections 364, 302/120B of the IPC was added.

Learned counsel for petitioner submits that petitioner is not named in the written report. The name of this petitioner has come in the confessional statement of co accused, namely, Saroj Devi. The petitioner is own cousin brother of the deceased.

In the written report, it is alleged that Bua of the informant had come from Ballia along with her minor son and daughter and they were sitting in the house of this petitioner.

Mere suspicion has been raised against this petitioner during investigation.

Petitioner is in custody since 25.7.2018 Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Buxar, in connection with Simri P.S. case no. 130 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
