The petitioner was directed to make payment of Rs.20 lacs through cheque to the complainant.

Learned counsel for the petitioner submits that petitioner has already paid Rs.17 lacs to the complainant and Rs.3 lacs was paid earlier to the complainant through R.T.G.S. but that amount is not being adjusted. Petitioner had taken Rs.20 lacs through cheque from the complainant. Petitioner is liable to pay only that amount and accordingly, petitioner was directed to pay Rs.20 lacs.

If the petitioner has already paid Rs.3 lacs through

Patna High Court CR. MISC. No.70548 of 2019(2) dt.06-11-2019 2/2 R.T.G.S. that amount is to be adjusted in the total amount to be paid to the complainant.

With this observation, this modification petition is disposed of.
