2. The petitioner is in custody in connection with Singhaul P.S. Case No. 91 of 2024 for the offence punishable under sections 329(3), 76, 64, 62, 352 and 351(i) of the BNS lodged on 14.07.2024 by the informant, Sunita Devi.
3. As per the prosecution story, the informant alleged that when she was sitting lonely in her house, the accused person entered and tried to outrage the modesty of the informant. When it was opposed, he tore the blouse and the Saree. As the villagers started assembling, he escaped. The informant has alleged that he has repeatedly done such act and she also complained it to the panchayat but nothing happened. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that due
Patna High Court CR. MISC. No.76793 of 2024(2) dt.29-10-2024 2/2 to land dispute, he has been implicated in the matter and no such occurrence took place.
5. Learned APP, Mr. Bharat Bhushan has taken this Court to the FIR to submit that she has complained that earlier she went to the Panchayat which failed to take any action and has resulted into the petitioner repeatedly storming her house and tried to outrage her modesty.
6. It is unfortunate that the elected representatives sitting in the panchayat failed to take into account such attitude of the accused person which result into the petitioner storming the house of the lady repeatedly, as alleged in the FIR.
7. In that background, no relief can be granted to him. Accordingly, the present bail application stands rejected. (Rajiv Roy, J) Adnan/- U T
