Petitioners are apprehending their arrest in connection with Complaint Case No. 1855 of 2018 for the alleged offence under Sections 323, 504, 506 and 384 of the Indian Penal Code. Learned counsel representing the petitioners submits that petitioners have no criminal antecedent. Referring to the prosecution case, he submits that from perusal of the complaint it would be evident that the present case has been instituted for the purpose of enhancing the rent of the tenanted shop which is in occupation of the petitioners.

Patna High Court Cr.Misc. No.74358 of 2018(2) dt.21-12-2018 2/2 Considering the fact that petitioners have no criminal antecedent and are running business in the tenanted shop of which the informant is the owner, this application is allowed. Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Complaint Case No. 1855/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also on the condition that bailors should be the family members.
