2. The petitioner seeks bail in a case registered for the offence punishable under Sections 309(4) of the B.N.S. Act and Section 27 of the Arms Act.
3. As per FIR, on the date of incident the petitioner make calls to the several suspicious number and as per the C.C.T.V. Footage, the activity of the petitioner was very suspicious.
4. Learned counsel for the petitioner submits that the petitioner is innocent, not named in the FIR and has been falsely implicated in this case. He submits that during investigation no cogent material against the petitioner has been collected by the police. He submits that the photo of the
Patna High Court CR. MISC. No.76595 of 2024(4) dt.27-01-2025 2/2 petitioner comes in the CCTV footage cannot confirm the involvement of the petitioner in the said crime. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Motihari Town P.S. Case No. 434 of 2024.
7. However, the petitioner is at liberty to renew his prayer for bail after framing of charge.
