2. The petitioner apprehends his arrest in connection with Bhagwanpur Hat P.S. Case No. 321 of 2025, registered for the offences punishable under Sections 126(2) 115(2), 303(2), 109, 74, 351(2), 3(5) of the BNS.

3. The petitioner along with others came at the house of the informant and hurled abuses. On protest being made, this petitioner assaulted the informant by means of iron rod over her head, shoulder and rib due to which she sustained serious injury. There is further allegation of snatching of valuable worth rupees more than One Lakh.

4. Learned Advocate for the petitioner submitted that there is counter version of the present case being Bhagwanpur

Case No. 320 of 2025, which is on earlier point of time and, in fact, the informant's side were pressurizing the petitioner to compromise the matter and when the petitioner did not succumb to the pressure, they assaulted the members of the petitioner's side. The prosecution case also falls to the ground for the simple reason that the informant has sustained only one injury, that too, found simple in nature, as is evident from the impugned order. The petitioner undertakes that he will fully cooperate in the proceeding of the court.

5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that because of assault, the informant has sustained serious injuries.

Regard being had to the submissions made on behalf of the parties and considering the factum of case and counter case, coupled with the simple nature of injury and the fair antecedent, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan/Successor Court, Siwan in connection with

Case No. 321 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
