JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-12-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 335 of 2018 for the offence under Sections 413, 414, 420, 467, 468/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. Referring to the prosecution case, learned counsel for the petitioner submits that the Apache Motorcycle was recovered from the tenanted house of one Punam Devi and not from the possession of the petitioner. He submits that the petitioner has no concern with the aforesaid motorcycle, which was recovered from the tenanted house of Punam Devi.
Considering the fact that the petitioner has got no criminal antecedent and the stolen motorcycle was recovered
Patna High Court Cr.Misc. No.76956 of 2018(2) dt.21-12-2018 2/2 from the tenanted premise of Punam Devi, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S.
