JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jehanabad P.S. Case No. 923 of 2018 registered for the offences punishable under Sections 364A of the Indian Penal Code. Petitioner is not named in the first information report but when the statement of victim was recorded under section 164 of the Cr.P.C, the name of petitioner surfaced in this case. The victim claimed that the miscreants were taking name of petitioner and others.

Submission on behalf of the petitioner is that except the aforesaid material as well as so called call details of the petitioner, there is nothing against him. He further submits that

No.66656 of 2019(32) dt.05-03-2020 2/2 moreover, co-accused Satyendra Yadav against whom there is serious allegation of kidnapping as well as demand of ransom, has already been granted bail by a co-ordinate Bench of this court vide order dated 22.04.2019 passed in Cr. Misc. No. 25062 of 2019 on the ground of compromise. He further submits that petitioner does not have any criminal antecedent which is evident from perusal of Para-3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, let above named, petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in Jehanabad P.S.
