2. The petitioners seek regular bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

3. As per prosecution case, allegation against these petitioners is to commit loot of cattle of informant who was carrying the seized cattle in connection with Kurlikot P.S. Case No. 16 of 2024.

4. It is submitted by learned counsel appearing on behalf of the petitioners that nothing has been recovered from conscious possession of these petitioners. Cattle has been recovered from Adiwasi Tola, Suhagi which is far away from the house of the petitioners. Charge sheet has already been filed. Petitioners claim clean antecedents. Petitioners are in custody since 28.8.2024.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Pothia Police Station Case No. 72 of 2024.
