2. The petitioner seeks bail in a case registered for the offence punishable under Sections 395, 379 and 397 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, this petitioner, along with other accused persons named in the F.I.R., committed robbery and looted cash of Rs. 1,50,000/- and fled away. Petitioner was identified by the local people who were present at the place of occurrence.

4. It is submitted by learned counsel for the petitioner that petitioner is innocent and has falsely been implicated in this case only on suspicion. No looted articles have been recovered from the conscious possession of this petitioner and till date, petitioner has not been put on T.I. Parade. Petitioner is in

Patna High Court CR. MISC. No.76626 of 2024(2) dt.20-12-2024 2/2 custody since 05.07.2024.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case, rival submissions, nature of accusation and period of custody, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Udakishunganj, in connection with Udakishunganj P.S. Case No. 30 of 2022.
