2. This is the 2nd attempt of the petitioner for regular bail in connection with Adhaura P.S. Case No. 72 of 2024 registered for the offence under Sections 8(c), 20(b)(ii)(c), 29 and 27(a) of the NDPS Act.

3. As per the prosecution case, 37.135 Kg of ganja is said to have been recovered from the house of the petitioner.

4. Earlier the prayer of the petitioner for regular bail was rejected by a Co-ordinate Bench of this Court on 21.02.2025 in Cr. Misc. No. 4076 of 2025.

5. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence.

The recovery has been made in the joint house of the family and not from the petitioner's house. He further submits that the trial has started and out of seven charge-sheeted witnesses, three have already been examined.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts, the period of custody and the observation made in the order dated 21.02.2025 passed in Cr. Misc. No. 21.02.2025 by a Co-ordinate Bench of this Court, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned concerned Court below, Kaimur at Bhabhua in connection with Adhaura P.S. Case No. 72 of 2024 subject to condition that:- (i). The petitioner will mark his attendance at the Adhaura Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii) The petitioner shall appear in
