2. The petitioner has preferred this application for grant of regular bail in connection with Gadhpura P.S. Case No. 71/2024 dated 14.06.2024 registered for the offence punishable u/s 364A of the Indian Penal Code.
3. As per the prosecution case, some unknown miscreants are alleged to have abducted the young brother of the informant and demanded ransom.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the F.I.R. The

It is further submitted that the co-accused, namely, Ashiki Kumar in his confessional statement in para 62 of the case diary has stated that due to assault by coaccused persons namely, Ashiki Kumar, Anshu Kumar and Shahanshah the deceased succumbed to his injury which shows that the petitioner has no complicity in committing murder of the deceased. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.06.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. It is furthr submitted that the confessional statement of the co-accused corroborates with the post-mortem report which shows the cause of death is due to asphyxia as a result of strangulation.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned / J.M. 1st Class, Begusarai, in connection with Gadhpura P.S. Case No. 71/2024.
