Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 353 and 332 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other 40 to 50 persons attacked the police party by pelting stones and created hindrance in discharging their duty at Panchayat Election- 2021 at Paraiya Block.

It is submitted that allegation against the petitioner is general and omnibus in nature. Though it is alleged that 40 to 50 persons started pelting stones causing damage to the government vehicle but there is no injury report of the police personnel on record and no specific overt-act has been attributed

Patna High Court CR. MISC. No.8857 of 2023(2) dt.20-06-2023 2/2 to the petitioner. Similarly situated co-accused persons have already granted bail by this Court vide order dated 22.11.2022 passed in Cr. Misc. No. 31525 of 2022. Petitioner claims clean antecedent.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Gaya in connection with Paraiya P.S. case no 257 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
