JUSTICE ARVIND SRIVASTAVA ORAL ORDER 24-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Informant. Petitioner apprehends arrest in connection with Basantpur P.S. Case No. 297 of 2022 registered for the offences under Sections 341, 323, 324, 307, 302, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that similarly situated co-accused person has already been granted regular and anticipatory bail by a co-ordinate bench of this Court vide order dated 13.01.2023 passed in Cr. Misc. No. 72703 of 2022. Further submission is that Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.73360 of 2022(2) dt.24-01-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 297 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
