The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420, 379, 120B of the Indian Penal Code. The allegation against the petitioner along with others is of involving in cyber fraud.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. Noting has been recovered from the conscious possession of the petitioner. The name of the petitioner has been implicated in this case only on the basis of confessional

Patna High Court CR. MISC. No.74637 of 2023(4) dt.21-06-2024 2/2 statement of co-accused Shubham Kumar who has already been enlarged on bail vide order dated 10.10.2023 passed in Cr. Misc. No. 62463 of 2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S. Case No. 323 of 2023.
