2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Pakribarawan P.S Case No. 143 of 2017 instituted for the offence punishable under Sections 465, 467, 468, 471, 420 of the Indian Penal Code and Section 12 of Passport Act.

As per prosecution story in short is that several cases have been registered against the petitioner for committing assault, attempt to murder, theft and outraging the modesty of woman and the police submitted charge against the petitioner in the several occurrence and it is also alleged that the petitioner

It is further alleged that the petitioner with a conspiracy for obtaining passport prepared a forged election identity card in the name of Md. Nadeem Imam whereas the petitioner name is Md. Bhadur and he entered his date of birth in the election identity card as 01.01.1983 and the petitioner applied for obtaining the passport in passport office, Patna. Passport office, Patna sent the application of the petitioner for verification to Pakribarwan P.S.. It is also alleged that the Pakribarawan police, after enquiry and verification found that M.D. Bhadur and Md. Nadeem Imam is the same person and Md. Bhadur has criminal antecedent and accordingly Pakirbarawan police sent the report the petitioner went to Durgapur and after furnishing the address of Durgapur obtained the passport from foreign department.

4. Learned counsel for the petitioner submits that petitioner has six criminal antecedents except this case. He also submits that petitioner is innocent and he has not committed any offence. He has been falsely been implicated in this case. It is further submitted that informant of the present case as well as his family memebers has lodged four cases against the petitioner and his family member out of four cases two cases were found false against the petitioner and his family member and due to

5. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

6. From perusal of the F.I.R., impugned order it appears that allegation against the petitioner is of making forged passport. Petitioner has six criminal antecedents which shows that he is of criminal nature and is habitual offender. Allegation against the petitioner is serious in nature.

7. Considering the facts and circumstances of the case, materials on record and submissions of learned counsel for the parties, I am not inclined to grant anticipatory bail to the petitioner.

8. Accordingly, prayer for anticipatory bail of the petitioner is hereby rejected.
