Learned counsel for the petitioner and learned counsel for the State are appearing and making submissions from their residence. The Court Master and Secretary are also part of this virtual court proceedings from their homes, all with the aid of audio visual technology.
Heard the parties.
Learned counsel for the petitioner submits that he would participate in the proceedings as and when they are conducted. Submission is that order of suspension was passed without giving any opportunity of hearing prior to the issuance of the
Patna High Court CWJC No.21496 of 2019(4) dt.16-06-2020 2/2 suspension order. On a specific query made by the Court as to under which provisions such an opportunity of hearing is required prior to issuance of an order of suspension, petitioner's counsel has not been able to point out any such Rule or provisions mandating such a requirement.
State counsel informs the Court that the petitioner has already filed his show cause in the proceedings which have commenced by charge-sheet dated 09.01.2020.
In view of the said developments, no case for interference is made out in the instant proceedings.
The writ petition is dismissed.
