JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code and u/s 7 of the E. C. Act.
As per the prosecution case, this petitioner was found involved in black marketing of subsidized food-grains. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that as a matter of fact card holders attached with the shop of this petitioner are regularly getting commodities but their names are not entered or thumb impression or Aadhar Card of the consumers are not accepting by the EPOS machine due to some technical problem and hence
Patna High Court CR. MISC. No.75235 of 2022(4) dt.26-06-2023 2/2 comparison of stock with EPOS machine is not legal and for this petitioner has already given information to the authorities. Moreover, during the pendency of this petition license of the petitioner has already cancelled by the S.D.O., Sadar, Patna. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case and nature of accusation against the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub divisional Judicial Magistrate, Patna in connection with Jakkanpur PS case No. 389/ 2022, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
