The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 394, 34 of the Indian Penal Code.
As per allegation in the FIR, informant is engaged in Bandhan Bank, Dobhi as Relationship Officer. His work is to collect the cash from customers and then deposit the same in bank. On 15.6.2023, while he was going to Bank to deposit the cash of Rs. 1,22,000/- in the meantime, three miscreants on a motorcycle, intercepted his motorcycle and looted away his entire money and other belongings and fled away. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Name of

Allegedly, cash of Rs. 5,000/- was recovered from petitioner's father-in-law, which is not a looted amount rather the same is his personal property. No TIP has been done as yet. This case is triable by learned judicial magistrate. Petitioner is languishing in judicial custody since 5.7.2023. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM 1st, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. Case No. 635 of 2023.
