2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 316 ( 2 ), 318 ( 4 ), 338 , 336 (3) of BNS.

3 . As per the prosecution case informant namely , Prabhu Sah alleged that these petitioners, under a conspiracy

Patna High Court CR. MISC. No.72141 of 2025(2) dt.14-10-2025 2/3 transferred their father's property solely to son of petitioner no. 1 by falsely representing him as only son and excluding informant from his share and as such , petitioners committed fraud with informant.

4. It is submitted on behalf of the petitioners that it was a bonafide mistake on the part of petitioner. After realizing the mistake , petitioners corrected the same within 3 days and on 09.09.2024 prepared a corrected gift deed for the same purpose but the present case was lodged on 01.12.2024 after the delay of three months of the correction in the gift deed. The dispute involved in this case is purely civil in nature . Petitioners claim clean antecedent.

5 . Learned counsel for the State oppose the bail petition .

6 Considering the facts that dispute involved in this case is purely civil in nature , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - I Bettiah West
