The petitioner is apprehending his arrest in connection with Sheikhpura P.S.case no.214 of 2012 registered for offences punishable under Sections 376, 379, 506 of the Indian Penal Code.

Allegation against the petitioner is that There is allegaitn of rape against the petitioner and it further appears from the impugned order that the process under Section 82 of the Cr.P.C. has already been issued.

Submission of the learned counsel for the petitioner is that the victim lady was aged about 65 years and no sign of rape was found on the person in the medical report. Heard learned A.P.P. also.

No.70383 of 2019(2) dt.16-01-2020 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
