JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the first information report and it would appear from perusal of the impugned order that petitioner was arrested in connection with Mehsi P.S. Case No. 23 of 2019 and gave his confessional statement disclosing his involvement in the present case and thereafter, he was remanded in this case on 25.03.2019 and since then he is languishing in jail custody.

Learned counsel appearing for the petitioner submits that except the so-called confessional statement that too

Patna High Court CR. MISC. No.66452 of 2019(2) dt.24-10-2019 2/2 recorded in another case, there is noting against the petitioner and moreover, several co-accused have already been granted privilege of bail by different Benches of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, West, Muzaffarpur in connection with Paroo P.S. Case No. 02 of 2019.
