====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-11-2025 Earlier, vide order dated 04.11.2025, this pre-arrest bail petition already stood dismissed as withdrawn in respect of petitioner no. 2 (Munni Devi).
2. Sole petitioner namely Raj Kumar Das apprehends his arrest in a case registered for offence under Sections 126(2), 115(2), 69, 352, 351(2) and 3(5) of B.N.S., 2023 and Sections 4, 6 of the POCSO Act.
3. It is alleged that on the false promise of marriage, co-accused Ram Adhar Das established physical relation with informant and thereafter, refused to marry her. It is further alleged that on 09.02.2025, when informant came to the house of co-accused Ram Adhar Das, he along with his family members including petitioner assaulted her with fist & slaps and
Patna High Court CR. MISC. No.74079 of 2025(3) dt.27-11-2025 2/2 dragged her outside the house.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely because he happens to be father of co-accused Ram Adhar Das, against whom, there is specific accusation of establishing physical relation with informant. Petitioner has got no concern with the alleged occurrence. Petitioner claims clean antecedent.
5. Learned counsel for the State and informant opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the petitioner namely Raj Kumar Das, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl.Sessions Judge VI cum Special Court (POCSO), Samastipur in connection with Mahhila P.S. Case No. 22 of 2025, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
