The petitioner is apprehending his arrest in connection with Chiksaura P.S.Case no.86 of 2018 dated 31.8.2018 , registered for offences punishable under Section 7 of the E.C. Act.
Allegation as per FIR 27 bags of wheat total 300 quintal were recovered near the temple and the villagers disclosed that they are kept for black-marketing and it is of P.D.S. and the petitioner is the PDS dealer.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and he has been falsely implicated at the instance of the villagers. Heard learned A.P.P. also.

No.78783 of 2018(2) dt.11-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Hilsa District Nalanda in connection with Chiksaura P.S.Case no.86 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to co-operate in the investigation otherwise his bail bond shall be cancelled. . With the aforesaid observation, this application is allowed.
