JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
Petitioner is in jail custody since 29.7.2019 on the accusation that he along with two others was caught with stolen motorcycle by local people while petitioner and his associates were trying to flee along with stolen motorcycle. Submission on behalf of the petitioner is that the petitioner was caught by local people only on the basis of suspicion and as a matter of fact, the petitioner was not involved in committing theft of the motorcycle. He, further, submits that petitioner does not have any criminal antecedents and the investigation against him has already been completed.

Case No. 226 of 2019.
