Patna High Court CWJC No.16783 of 2024 dt.30-10-2024 2/3 (Per: HONOURABLE THE CHIEF JUSTICE) Date : 30-10-2024 The petitioner has sought for participation in an eTender issued on 20.09.2024 and also sought for issuance of completion certificate for the Financial Years 2019-20, 2020-21 and 2021-22.

2. Insofar as the participation in the tender issued, it is submitted by the learned Counsel appearing for the respondents that the tender has been finalised and hence, the prayer has become infructuous.

3. Insofar as the second prayer to direct the respondents to issue completion certificate for the Financial Years 2019-20, 2020-21 and 2021-22, we made a specific query as to the statement made in the writ petition, of the date on which the completion was effected; which alone can lead to a prayer for mandamus for a completion certificate to be issued. There is no averment to that effect.

4. It is the petitioner's contention that for the aforesaid years, the audit has been completed and their report has been submitted. The respondent could consider expeditious issuance of a completion certificate; which can be only on the satisfaction of the respondent authorities that the petitioner has complied with the conditions of the work entrusted.
