Smt. Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-01-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Hasanpur P.S. Case No. 211 of 2017 registered for the offence punishable under Sections 379 and 461 of the Indian Penal Code.

The allegation in the present case is regarding unknown accused persons having committed theft by breaking open the A.T.M. and having stolen cash amounting to a sum of Rs. 3,37,000/-.

The learned counsel for the petitioner submits that the petitioner has been made accused in the present case falsely on account of his bad criminal antecedent and the fact is that neither any recovery has been made from the conscious

Patna High Court Cr.Misc. No.79344 of 2018(2) dt.18-01-2019 2/2 possession of the petitioner nor there is any material to suggest the complicity of the petitioner with the alleged crime. The petitioner is stated to be in custody since 23.07.2018. The learned counsel for the petitioner submits that the petitioner is ready to be imposed with such conditions as this Court thinks fit and proper.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Rosera, District-Samastipur in connection with Hasanpur P.S. Case No. 211 of 2017. It is further directed that the petitioner would mark his presence before the Officer In-Charge of the concerned Police Station at 10:30 A.M. on each and every Monday of the week and on account of his failure on two consecutive occasions to mark his attendance, the present privilege of regular bail shall stand cancelled automatically and the petitioner shall be taken into custody.
