2. The petitioners are apprehending arrest in connection with Bhore P.S. Case No. 323/2025 for the offences punishable under Sections 126(2), 115(2), 303(2), 74, 308(4), 351(1), 352 and 3(5) of the BNS, lodged on 08.07.2025 by the informant, Renu Devi.
3. As per the prosecution story, the informant alleged that her husband is in abroad and she stays with her daughter. On 24.06.2025, Surendra Gond came flashing revolver informed that she has to pay extortion amount and tried to outrage her modesty. Further, the petitioner no.1 herein and Hans Raj Singh tried to damage the under construction wall. Allegation further is that Surendra Gond wanted money to be handed over next morning while the petitioner no.2 , next day came and
Patna High Court CR. MISC. No.74720 of 2025(2) dt.19-11-2025 2/3 abused/outraged the modesty. This led to the FIR.
4. Learned counsel for the petitioners submit that the allegation is of 25.06.2025, the FIR has been lodged on 08.07.2025 and no reason has been given for the said belated FIR. Further, both these father and son duo have no criminal antecedent and only due to land dispute, implicated. The main allegation is against Surendra Gond.
5. Learned APP opposes the prayer submitting that all of them threatened the lady/daughters.

Taking into account the submissions of the parties as also the fact that no reason has been given for the belated FIR, both these petitioners have no criminal antecedent, the main allegation is against Surendra Gond, in that background, this Court is inclined to extend them the privilege of anticipatory bail.
7. Let the petitioners be released on bail, in the event of their arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each in connection with Bhore P.S. Case No. 323/2025 to the satisfaction of learned SDJM, Gopalganj subject to the conditions as laid down under Section 438(2) of
Patna High Court CR. MISC. No.74720 of 2025(2) dt.19-11-2025 3/3 the Cr.P.C. as also the other conditions.
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official document to show his/her bona fide;
(ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioners shall co-operate in the investigation and make themselves available to the police as and when required;
(iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(vi) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) Ravi/- U T
