JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 467, 468, 471, 420, 406 ann of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons took Rs. 8,20,937/- from the father and brother of informant for providing a piece of land but neither they provided the land nor returned the money. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is further submitted that entire money with interest amounting to Rs. 9,60,000/- has been returned in the account of the father of informant through RTGS on 01/01/2023. Petitioner has got clean antecedent.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Danapur in connection with Danapur PS case No. 369/ 2022, subject to conditions laid down u/s 438(2) of the Cr.P.C.
