Petitioner, apprehends his arrest in connection with Warsaliganj P.S. Case No. 224 of 2019 registered for the offences punishable under Sections 341, 323, 337, 338, 332, 379, 411, 147, 148, 149, 353, 307 & 504 of the Indian Penal Code and Section 4/21 MMC (DR) Act, 1987 and Section 4/40 of Bihar Minor Mineral Rule 1972 and Rule 4, 5(a), 5(C), 8(C) of Bihar Minerals (Prevention of illegal Mining, Transportation & Storage) Rules, 2003 and 15 of Environmental Act, 1986.

Patna High Court CR. MISC. No.75654 of 2019(3) dt.06-01-2020 2/3 Informant who is a police officer has alleged that in the late night he received information that illegal mining of sand, is going on and sands has been loaded on tractor and being transported by the accused persons and on receiving said information he reached the spot where trailor loaded with illegal sand were seized. It is further alleged that some persons formed an unlawful assembly and started pelting stones in which petitioner is also named as accused.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to animosity and village rivalry as he is supporter of one of the Ward Member of village panchayat. He has no criminal antecedent and there is no allegation of any offence committed by him under the Mining Act.

Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bond of Rs. 20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Nawada, in connection with Warsaliganj P.S. Case No. 224 of 2019, subject to the
