2. The petitioner seeks bail in connection with Lakho P.S. Case No. 160/2025 registered for the offences punishable under Sections 30(a), 32(3), 41(2) of the Bihar Prohibition & Excise Act, 2018.

3. As per the prosecution case, on 21.07.2025 when the police was on patrolling duty, they stopped a vehicle carrying illegal alcohol near Begusarai. They received an information that a white Sumo Gold car with a saffron flag was transporting foreign liquor. When police arrived, the driver and one passenger tried to escape. Police caught one person named Kishan Kumar (petitioner), but another person namely, Sanatan Kumar fled away. On search, 433.340 liters of illegal foreign liquor was recovered

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel for the petitioner further submits that the name of the petitioner has come merely on the ground of suspicion as during the checking the petitioner was crossing the said way and he is neither the driver nor the owner of the said Sumo Gold vehicle and the recovered liquor. Learned counsel further submits that petitioner has one criminal antecedent and he is in custody since 23.07.2025.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-I, Begusarai in connection with Lakho P.S.
